SCHOLARSHIP ROUNDUP

On Islamic Law

  • In "Siyāsa in the Bahmani Sultanate and the Death of Maḥmūd Gāwān" (Islamic Law and Society, April 23, 2025), Meia Walravens (Trinity College Oxford) "takes up the study of the [Bahmani] sultanate's legal history through the topic of siyāsa, i.e. the sultanic power to judge over subjects independently and exercise discretion."
  • In "Breaking barriers: Women in leadership in Iran" (Law360 Canada, May 1, 2025), Maria Mahmoudian (University of Toronto) argues that in Iran, gendered "expectations are reinforced by state-enforced legal codes rooted in a conservative interpretation of Islamic law, which explicitly restricts women's access to high-level political positions."
  • In "Why does Hefazat fear women's rights more than usury?" (The Daily Star, May 7, 2025), Taqbir Huda (Harvard Law School) observes that "[o]ne important reason why gender reform provokes outsized outrage—while violations of Islamic prohibitions on riba (interest or usury), elite corruption, or exploitative labour markets do not—is that family law has historically been the only legal domain where Islamic law retained formal legitimacy under colonial rule."
  • In "Slavery and the Forgotten History of Religious Liberty" (BYU Law Review, forthcoming), Audra Savage (Wake Forest University School of Law) "explor[es] the historical role played by law and religion in the development of slavery in America."
  • In "Underage Marriage: Legal and Social Practice in Muslim Jurisdictions" (Arab Law Quarterly 2025),Dörthe Engelcke (Max Planck Institute for Comparative and International Private Law), Dominik Krell (University of Oxford - Centre for Socio-Legal Studies), and Nadjma Yassari (Swiss Institute of Comparative Law) observe that "[i]n an effort to curb early marriage, a practice that involves predominantly girls, legislatures in Muslim jurisdictions have introduced a fixed legal age of marriage and have increased state oversight over the authorisation of early marriages."

On Islam and AI/Data Science

  • In "Ethical Implications of Artificial Intelligence: An Islamic Perspective" (Journal of Religion and Society 3, no. 1 (2025)), Dr. Khanzada Muhammad Waqar and others (Lecturer, Department of Seerat Studies, University of Peshawar) "explore[] the ethical implications of AI within the framework of Islamic teachings, emphasizing key concepts such as accountability (mas'ūliyya), justice (ʿadl), and the sanctity of human dignity."
