ISLAMIC LAW IN THE NEWS

  • "Sheikh Abdullah Saleh Kamel, chairman of the Islamic Chamber of Commerce and Development (ICCD), affirmed that the halal economy has become a strategic pillar in building an integrated Islamic economy, representing one of the two wings of development alongside Islamic finance. . . . [He] made the remarks while addressing the 41st session of the Committee for Economic and Commercial Cooperation of the Organization of Islamic Cooperation (COMCEC) in Istanbul."

CASES, FATWÄ€S, LEGISLATION ON ISLAMIC LAW

  • In Malaysia, the "Mufti (Federal Territories) Bill 2024 is expected to be tabled for the second reading at the next Parliament session. . . . The bill aims, among other things, to provide for matters relating to the mufti and the determination of Islamic law and doctrine." For more content and context on Islamic law in Malaysia, consult our Editor-in-Chief Professor Intisar Rabb's "Legislation and Regulation of Islamic Law in Malaysia" and its appended resource roundup.
  • "The Lahore High Court (LHC) [Pakistan] says that dependent parents have the right to file maintenance suits against their children before family courts, ruling that such cases fall within the courts' jurisdiction under the Family Courts Act, 1964. . . .The family court had ordered Khawaja and his other three brothers to pay Rs5,000 per month as interim maintenance to their mother by the 14th day of each month. . . . [T]he mother's counsel maintained that under Islamic law and moral obligations, sons are bound to maintain their parents if they are in need and have no independent means of income."
  • "Amir Raisian, the defense attorney for Sharifeh Mohammadi, a labor activist imprisoned in Lakan Prison of Rasht [Iran], announced that her death sentence has been commuted to 30 years in prison following an order from the head of the Judiciary. . . . Raisian also emphasized that legal efforts continue to pursue a retrial or the application of Article 477 of the Criminal Procedure Code, with the goal of ultimately overturning Mohammadi's conviction and acquitting her of the charge of baghi (armed rebellion). Article 477 of the Criminal Procedure Code is considered a special and exceptional legal provision that allows the head of the Judiciary to order a case to be referred to the Supreme Court for retrial if a final verdict is deemed to be 'in clear contradiction with Islamic law.'"
  • "The State Property Authority in the city of Jaghbub  [Libya] has handed over the sites of the Imam Muhammad bin Ali al-Senussi Zawiya and the Religious Institute, decades after they were vandalized in 1984. The Authority stated that the handover of the Zawiya and the Institute is part of its efforts to preserve religious endowments and revive historical landmarks."
  • In India, the Madras High Court "held that adoptions among Muslims must follow the statutory route under the Juvenile Justice Act, and personal law concepts like kafala cannot override the legal framework designed to protect child welfare."
  • "United States Senator Ted Cruz, has reaffirmed his commitment to advancing legislation that targets the enforcement of Sharia and blasphemy laws in Nigeria, following President Donald Trump's designation of the country as a 'Country of Particular Concern.'"
  • Human Rights Watch issued a report that discusses the effect on journalists of Afghanistan's "Law on the Propagation of Virtue and Prevention of Vice enacted in August 2024, [under which] inspectors check to ensure that media content complies with Sharia (Islamic law)."
