ISLAMIC LAW IN THE NEWS

  • Shaykh Ahmad Gumi, Mufti of the Sultan Bello Mosque in Kaduna, Nigeria, "has urged Islamic judges and clerics to ensure that women suffering from domestic abuse are granted the right to divorce their husbands without being compelled to pay any form of compensation."
  • "Police in the city of Kano, in northern Nigeria, arrested 25 people after raiding an alleged 'gay wedding'. The religious police, also known as Hisbah, stormed a gathering held at an event centre in Kano, where the alleged wedding ceremony was set to take place."
  • "The Supreme Council for Shari'ah in Nigeria (SCSN), Kaduna State Chapter, has strongly criticized recent comments by Reverend Matthew Hassan Kukah, which linked the implementation of Shari'ah law in northern Nigeria to rising violence."
  • "African Risk Capacity Limited, the commercial insurance affiliate of the African Union's African Risk Capacity Group, has announced the launch of...a non-profit facility that enables governments, communities, and insurers to access climate risk coverage consistent with Islamic principles."
  • "The President of Colombia, Gustavo Petro, announced that the country has obtained 'Halal' certification for the export of coffee and cocoa to Arab countries."
  • Hong Kong "Financial Secretary Paul Chan Mo-po has signaled the city's readiness to tap into the burgeoning global Islamic finance market to fund its ambitious Northern Metropolis megaproject."
  • "The world's first Muslim-friendly cruise will launch in Malaysia this November. Dubbed the M/V Piano Land, the cruise will offer a range of facilities and services specially targeted towards Muslim cruisers, such as 100 per cent halal food, mocktails and other alcohol-free beverages, dedicated prayer rooms and onboard prayer time guidance."
  • In the United Kingdom, "University of Birmingham humanitarian and migration experts are creating a blueprint to help Islamic philanthropists better contribute to transforming humanitarian responses for displaced women. ...Islamic philanthropy is a multi-billion-dollar global sector. Zakat – the mandatory, obligatory form of charity for eligible Muslims – is alone estimated to generate up to $1 trillion annually worldwide."

CASES, FATWÄ€S, LEGISLATION ON ISLAMIC LAW

  • In India, "The legal heirs of Shah Bano Begum have approached the Indore High Court, seeking an immediate stay on the release of the upcoming film HAQ, featuring Yami Gautam Dhar and Emraan Hashmi in lead roles. In their petition, filed through advocate Tousif Warsi, the family has alleged that HAQ offends the sentiments of the Muslim community and portrays Sharia law in a derogatory and misogynistic manner."
  • "A coalition of civil rights and faith-based organisations has faulted renewed advocacy for the expansion of Sharia law in Nigeria. ...The coalition urged the National Assembly to initiate constitutional reforms to restrict Sharia's jurisdiction strictly to personal matters for consenting Muslims and to consider removing Sections 260–264 and 275–279 of the Constitution, which provide for Sharia Courts of Appeal at the federal and state levels."
  • "The Ipoh High Court [Malaysia] has granted a 26-year-old man's application to be legally recognised as a Hindu, ruling that he is not a Muslim. Justice Bhupinder Singh said there was no evidence to suggest that the man – whose suit was against the national registration department (JPN) and the Perak Islamic religious and Malay customs council (MAIPk) – had ever professed Islam. ...The court also noted that the man's parents were never legally married. As an illegitimate child he could not be said to have taken his father's religion, the judge said."
  • In Knysna, South Africa, "The Portfolio Committee on Home Affairs was informed by the Muslim community of Garden Route District Municipality that the Marriage Bill will have an unintended consequence of relegating Islamic marriages to man-made laws. ...[Among other concerns,] participants raised alarm that some provisions, including the provision that in a polygamous marriage the first wife must give written consent will undermine other subsequent marriages especially because Islamic law gives equal status and validity to all individual marriages in a polygamous setting. Also, there were views that women's rights are protected by Islamic law and that the Marriage Bill will undermine protections offered under Islamic law."
