CASES, FATWĀS, LEGISLATION ON ISLAMIC LAW - The Supreme Court of Kenya recently held that children born out of wedlock can inherit their father's estate according to Islamic law. "A section of Muslim religious leaders at the Coastal region have strongly opposed [the] ruling that allows children born out of wedlock to inherit property from their deceased Muslim fathers, terming it a violation of Islamic law and the jurisdiction of Kadhi courts."
- Bahrain's Sharia Court of Appeal voided the transfer his house to his wife, ruling that the gift had no effect. The Court was persuaded that the transferor was in poor health at the time of the gift and that the house should revert to the deceased's estate and be distributed according to Islamic inheritance law.
- "A powerful religious decree has been issued by Grand Ayatollah Naser Makarem Shirazi, one of Iran's most senior Shia clerics, targeting U.S. President Donald Trump and Israeli Prime Minister Benjamin Netanyahu. The fatwa — a formal ruling under Islamic law — brands both leaders as "enemies of God" and calls for Muslim unity in confronting them."
- "The Federal Court [of Malaysia] in a 3-1 decision ruled that Selangor's 2014 fatwa could not be used against SIS Forum (Malaysia) as it is a company, which means the fatwa no longer labels it as "sesat" or deviant from Islamic teachings."
- "The Telangana High Court [India] has come up with a detailed step-by-step procedure for granting Khula, a form of dissolution of marriage initiated by the wife under Islamic law, without requiring her husband's consent, under Muslim personal law."
- Commenting on the issue of fatwā issuance and institutions, Egypt's Grand Mufti Dr. Nazir Ayyad wrote: "This vision necessitates the institutionalization of the fatwa process, transforming it from an individualistic endeavor into a collaborative, research-driven enterprise. It requires the establishment of specialized research centers, comprehensive training programs for muftis, and sophisticated systems for monitoring and analyzing social trends and emerging challenges. These mechanisms enable fatwa institutions to respond proactively with relevance, precision, and intellectual integrity."
