SCHOLARSHIP ROUNDUP

On Islamic Law

  • In "Is There a 'Jury' in Islamic Law? The Twelve-Witness Lafīfiyya Testimony and the Limits of Judicial Discretion" (Studia Islamica 120 (2025)), Ari Schriber (Utrecht University) "examines the juristic conception and judicial application of the lafīfiyya" defined as "a testimony of twelve ordinary Muslims whose concurring statements are considered probative in Islamic law of the Maghrib."
  • In "Looking for Moderate Fiqh" (Al-Istinbath: Jurnal Hukum Islam 10, no. 1 (2025)), Wildani Hefni (Fakultas Syariah UIN Kiai Haji Achmad Siddiq Jember, Indonesia) and others explore Professor Mohammad Hashim Kamali's efforts to reform Islamic law by advocating for a balanced, flexible approach that counters rigidity and promotes moderation in contemporary fiqh discourse.
  • In "Generation Z's Perception of Religious Tolerance and Implementing Islamic Law in Indonesia" (Al-Istinbath: Jurnal Hukum Islam 10, no. 1 (2025)) Dwi Aprilianto (Universitas Islam Lamongan, Indonesia) and others examine the attitudes of Indonesian Gen Z individuals, particularly in Lamongan and Surabaya, towards religious diversity and the application of Islamic law. Utilizing both quantitative surveys and qualitative interviews, the study reveals that while many Gen Z members exhibit openness and inclusivity, especially in interfaith interactions, opinions diverge on issues like accepting non-Muslim leaders and enforcing Islamic legal punishments.

On Islam and AI/Data Science

  • In "The Zakatability of AI: A Dual Analysis from Sharia and Saudi Law" (Journal of Posthumanism 5, no. 5 (2025)), Saud M. Alholiby Albin and others (Zaid College of Law, King Faisal University, Al Ahsa, Saudi Arabia) examine whether artificial intelligence assets are subject to zakat (Islamic almsgiving), analyzing the issue through both classical Islamic jurisprudence and contemporary Saudi legal frameworks.
