ISLAMIC LAW IN THE NEWS

  • "The Taliban's Ministry for the Promotion of Virtue and Prevention of Vice has introduced new restrictions on Afghan women, mandating that they refrain from performing Takbir—an Islamic expression of faith—and from reciting the Quran aloud, even in the presence of other women, according to Virginia-based Afghan news channel Amu TV." For more content and context on the recent developments in Afghanistan, consult our Editor-in-Chief, Professor Intisar Rabb's "Resource Roundup: Afghanistan, the Taliban, and Islamic Law."
  • South Africa's Home Affairs Department issued its first-ever certificates for Muslim marriages, addressing a legal gap and promoting inclusivity within personal law.
  • Nigeria's Grand Qāḍī advocated for judicial decisions in sharī'a-compliant regions to fully align with Islamic principles, underscoring the role of sharī'a in delivering justice.
  • The Maldives' use of ṣukūk, a sharī'a-compliant bond structure, has been estimated to have reached approximately $500 million.
  • "Financial Secretary Paul Chan says Hong Kong is ready to relaunch its drive to develop Islamic finance, after a three-day trip to the Saudi capital Riyadh opened his eyes to the untapped potential of developing more financial products that comply with Islamic law."
  • "The Grand Kadi of the Kwara State [Nigeria] Shariah Court of Appeal, Justice Abdullateef Kamaldeen, has inaugurated an 11-member Ekiti State Shariah Arbitration Panel, pledging that the panel will serve justice impartially, regardless of religious affiliation."

CASES, FATWĀS, LEGISLATION ON ISLAMIC LAW

  • Regarding the "recent uproar in the National Assembly [of Nigeria] . . . centered around the lawmaker who proposed rephrasing Islamic personal law to Islamic law in the constitution," some have argued that the issue is a distraction and that "the members of the House of Representatives spen[t] considerable time showcasing their ethnic supremacy and intolerance towards one another." For more content and context on Nigeria and its legal system, consult the "Country Profile: Nigeria" page on SHARIAsource.
  • In Bangladesh, where adoption by Muslim families is not allowed, Muslims wishing to establish legal ties with children not related to them by birth have used and continue to use the Guardians and Wards Act of 1890, "where a person or couple can be appointed only as a legal guardian of the child."
