ISLAMIC LAW IN THE NEWS

  • Speaking at the UN Security Council meeting, "Amina J. Mohammed, the Deputy Secretary-General of the United Nations, stated that support for the rights of Afghan women must be expanded." "The Islamic Emirate has not yet commented on this; however, it has consistently denied allegations of violating women's rights in the country, asserting that all women's rights are protected under Islamic law."
  • "An Afghan province has banned all media from showing images of living things to ensure compliance with the Taliban's morality laws." For more content and context on the recent developments in Afghanistan, consult our Editor-in-Chief, Professor Intisar Rabb's "Resource Roundup: Afghanistan, the Taliban, and Islamic Law."
  • "Saudi Arabia executed seven people on Wednesday, including five for drug trafficking, the official Saudi Press Agency (SPA) said. The deaths brought the total number of executions carried out this year in the Gulf kingdom to 236, according to an AFP tally based on official statements." For more content and context on harsh interpretations and applications of Islamic criminal law, consult our Editor-in-Chief, Professor Intisar Rabb's "Resource Roundup: Islamic Criminal Law." For more news blurbs relating to harsh applications of Islamic criminal law, consult our "Islamic Criminal Law in the News Roundup."
  • "The top adviser of Pakatan Harapan's component Amanah [Malaysia] has backed a controversial bill that would grant unprecedented powers to the Federal Territories mufti, a stand likely to pit the ruling party against Muslim scholars, religious groups  and rights lawyers who have spoken out against the proposed law. Ahmad Awang also defended one of the main contentious points in the Mufti (Federal Territories) Bill 2024, which stipulates that only a person belonging to certain streams within the Sunni school of thought can hold the office of the FT mufti, a position that comes with sweeping powers that will be binding on all Muslims if the bill is passed."
  • According to some scholars who have criticized the Mufti (Federal Territories) Bill 2024 [Malaysia], "[i]n Islam, a fatwa has always been a non-binding opinion issued by a shariah scholar on matters of Islamic law and practice. It was never intended to have any legal consequence in the nature of punishment imposed on a Muslim. But all that will change if the Mufti (Federal Territories) Bill 2024 is passed into law by Parliament. In my view, the proposal to turn fatwas into enforceable laws is a direct attack on the spine of the Federal Constitution itself."
  • "The House of Representatives [of Nigeria], rejected a bill seeking to expand Islamic law in the 1999 constitution. The constitutional amendment bill sponsored by Aliyu Missau, intended to amend sections 24, 262, 277, and 288 of the 1999 constitution by removing the word 'personal' wherever 'Islamic law' is mentioned. . . . Leading the debate, Missau said the inclusion of the word "personal" after "Islamic" restricts its application, especially on Islamic commercial laws. "Opposing the bill, Solomon Bob from Rivers argued that the amendment would expand the application of Islamic law beyond the 'personal matters' intended by the framers of the Constitution."

CASES AND FATWĀS

  • "The fatwa, declaring the beliefs, teachings and practices of members of GISB Holdings Sdn Bhd (GISBH) and its affiliates as deviating from the true Islamic teachings, has been gazetted and published in the Selangor State Government [Malaysia] Gazette."
