SCHOLARSHIP ROUNDUP

On Islamic Law

  • Simon Doubleday (Hofstra University) talked with Jerrilynn Dodds about her new book: Visual Histories from Medieval Iberia: Arts and Ambivalence (Arc Humanities Press, 2024).
  • In "Codicology and the Transformation of Islamic Law: A First Assessment of the Tarjīḥāt al-bayyināt in the Princeton Garrett Collection" (Journal of Islamic Manuscripts, September 15, 2024), Tobias Scheunchen (University of Chicago) examines "summary-like lists labelled 'tarjīḥāt al-bayyināt,'" arguing that "they served as a shorthand for legal practitioners familiar with evidentiary law and that their presence suggests a broader transformative process of readers'/legal practitioners' relationship with codices of positive law at this critical moment in the history of Islamic law."
  • Elias G Saba (Grinnell College) reviews Youcef L. Soufi's (University of Toronto) The Rise of Critical Islam: 10th–13th Century Legal Debate (New York: Oxford University Press, 2023)

On Islam and Data Science

  • In "Sextortion, Gender, and Digital Crime: A Socio-Legal Comparison between Positive and Islamic Law" (Jurnal Hukum dan Pranata Sosial 19, no. 1 (2024)) J.M.  Muslimin (Universitas Islam Negeri Syarif Hidayatullah, Jakarta) and others, using "normative and empirical legal research," argue that "in Islamic law, sextortion can be categorized as a part of jarīmah (criminal act) with a punishment named ta'zīr, in which the government becomes the one who determines the type of punishment."
