  • In "Generality and Exception in Islamic Legal Theory: Intent, Language, and the Jurist's Role" (American Journal of Comparative Law, forthcoming), Omar Farahat (McGill University Faculty of law) "focuses on the generality-specificity dyad as a tool designed to ensure [Islamic] law's internal cohesiveness, the coherence of its claims to legitimacy, and its practicability."
  • In "Khul'a without husband's consent in the eyes of Shariah vs Superior Courts of Pakistan: A critical analysis" (SSRN, June 30, 2024), Muhammad Sarim Tahir (Islamic International University) "examines the requirement of husband's consent in Khula, a form of divorce in Islamic law, from the perspective of the Quran, Sunnah, and all five schools of thought. . . . [and] critiques the decisions of the Supreme Court and Federal Shariah Court of Pakistan, which have deviated from the traditional Islamic understanding of Khula by converting a conditional right into an absolute right."
  • In "Islamic Law: Between Revelation and Human Thoughts" (Afkar: Jurnal Akidah & Pemikiran Islam 26, no. 1 (2024)), Zarul Arifin (Institut Agama Islam Sultan Muhammad Syafiuddin Sambas) and Abdurrahman Raden Aji Haqqi ( Universiti Islam Sultan Sharif Ali, Brunei) "examine how revelation and human thought work together in establishing Islamic law. For example, when issuing contemporary fatwas for which there is no explicit argument from the Qur'an or Hadith, the ulama' use reason or their intellects in formulating fatwas, ensuring that these fatwas do not conflict with the Qur'an or Hadith."

  • In "Women and Sharia Law in the UK" (in Religious Minorities in Pluralist Societies, eds. Roberta Medda-Windischer and others (Brill, 2024)), Elham Manea (University of Zurich), "[b]ased on field work conducted by the author . . . present[s] the political and legal context and consequences of the application of Islamic Law in the UK Sharia Councils and Muslim Arbitration Councils."

The Field Guide to Islamic Law Online is an ever-growing collection of links to hundreds of primary sources and archival collections around the world, online. We recently added a new resource to this list:

  • Rah-i Mujahid is a Farsi periodical that can be accessed online through a webpage maintained by the Digital Library of the Middle East. The online collection comprises more than 50 issues of the periodical.
